1. Acceptance of Terms
By accessing or using the Buildable platform ("Service") operated by Buildable ("we", "our", "us") at buildable.construction and the associated mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.
2. Description of Service
Buildable is a construction management platform that enables subcontractors and construction teams to log work, manage projects, process approvals, track site attendance, and generate reports. The Service is provided as a web application and progressive web app (PWA).
3. Accounts and Registration
To use Buildable, you must be invited by an organisation administrator or have an account created on your behalf. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
You must provide accurate and complete information when your account is created and keep your information up to date.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these terms. You agree not to:
- Submit false, misleading, or fraudulent work logs, timesheets, or other data
- Use the Service to misrepresent site attendance or work completed
- Attempt to gain unauthorised access to other users' accounts or data
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to transmit malware, viruses, or other harmful code
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service in any way that violates applicable laws or regulations
5. Data and Content
Your data: You retain ownership of all data and content you submit to the Service, including work logs, photos, documents, and project information ("Your Data"). By using the Service, you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service to you and your organisation.
Accuracy: You are responsible for the accuracy of data you submit. Work logs, hours, and quantities should reflect actual work performed.
Photos and images: Photos uploaded for work logs or location sign-ins are stored securely and are accessible only to authorised users within your organisation.
6. Organisation Accounts
Buildable operates on a multi-tenant basis. Organisation administrators have the ability to:
- Create and manage user accounts within their organisation
- Configure projects, task categories, and pricing
- View, approve, and export work data submitted by their team members
- Set access permissions and project assignments
If you are a worker or team member, your use of the Service is also subject to any policies set by your organisation's administrator.
7. Availability and Support
We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We provide support via email and will make reasonable efforts to respond to enquiries in a timely manner.
8. Fees and Payment
Access to Buildable is provided on terms agreed between us and your organisation. Pricing is determined on a per-organisation basis. Any applicable fees, billing terms, and payment schedules will be set out in a separate agreement with your organisation's administrator.
We reserve the right to modify our pricing with reasonable notice to affected organisations.
9. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by Buildable and protected by intellectual property laws. These terms do not grant you any rights to our trademarks, logos, or branding.
You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, Buildable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability for any claim arising from these terms or the Service shall not exceed the amount paid by your organisation for the Service in the twelve months preceding the claim.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold Buildable harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time if you breach these terms or if your organisation's account is terminated. Your organisation's administrator may also remove your access at any time.
Upon termination, your right to use the Service ceases immediately. We will retain Your Data for a reasonable period to allow export, after which it may be deleted in accordance with our Privacy Policy.
13. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.
14. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
